Hall County and its cities may have chosen to compromise on local option sales tax distribution if they had known the Georgia Supreme Court is debating the whole concept of “baseball arbitration.”
The Georgia General Assembly attempted to simplify LOST negotiations between cities and counties in 2010 by adding a mediation period and then court arbitration for parties that couldn’t agree. The county association does feel the 2002 expiration method gives more leverage depending on what’s at stake, Mueller said. He also said some areas would like to get rid of LOST. ACCG plans to look at advocating a constitutional amendment.
“We’ve recognized for a long time that there are problems with the local option sales tax renegotiations that have to occur every 10 years,” Mueller said. “It pits counties against cities fighting over a set pot of funds, and it’s not healthy for their relationship. Sometimes, when there’s already a bad relationship there, it just makes it worse.”
Rep. Carl Rogers, R-Gainesville, said the legislature may have to pass an amendment to the state constitution that would do away negotiation and limit the amount of litigation. It’s especially been an issue since the economic downturn.
“This has continued to be a sticking point,” Rogers said. “We’ll have to come up with some kind of solution and it won’t satisfy everybody.”
