A former Westmoreland police officer was arrested on charges of statutory rape after being accused of having sex at least twice with an underage girl.
John Edwin Puckett, 49, was arrested by the Sumner County Sheriff’s Office on Tuesday and charged with aggravated statutory rape and soliciting sexual exploitation of a minor.
According to an affidavit filed in a Sumner County Court, Puckett admitted to Westmoreland Police Chief Kenneth Smith that he had sex with the unidentified girl. Puckett then resigned his commission.
Smith confirmed the affidavit’s account in an interview Wednesday, saying he went to the Puckett’s house on Tuesday morning when the officer failed to show up for work.
Smith said Puckett told him that he had gotten himself into major trouble and needed to resign.

The affidavit also stated a sheriff’s deputy found nude photos of Puckett on the victim’s cell phone, as well as a video of him performing a sex act. The former officer declined to talk with investigators, the document said.

Nevertheless, the chief said he has no issue with how the investigation has been handled into the officer he once supervised.
“When a police officer crosses a line like this, it needs to be dealt with and he needs to be charged,” Smith said.
Westmoreland Mayor Mike Carter said Wednesday that he was also caught off guard when he learned of Puckett’s arrest.
“When I was made aware of it, it came as a shock because we like to think our police department is as professional as any police department,” he said. “It’s very unfortunate for the city, our police department and everybody involved, families and so on.”
Puckett passed all of his background checks before he was hired, Carter said.

Besides, the content of most Americans’ messages can probably be examined without recourse to the judges under one of the blanket authorisations issued by FISC. And if you’re not American, or an American resident who once spoke to somebody abroad by phone, then you’re in a free-fire zone.

The case against Moody and a co-defendant, Devin Newman, relied heavily on wire-tapped cellphone calls and intercepted text messages along with controlled drug buys, according to court documents.
St. John and Newman's attorney, Timothy M. Farris, argued that the wiretap laws as currently written were too vague to include newer technology like cellphones and texting in wiretap warrants and therefore any evidence gathered by the police in connection to them should be thrown out.
The original law was written in 1968 and has never been updated.
"We presented the best case we could and were joined by a number of other groups ... including the Massachusetts branch of the American Civil Liberties Union," St. John said.
The attorney said it was an important issue because it dealt with privacy rights.

"The SJC's decision is a sound one, utilizing both a careful reading of the legislative intent behind our wire communication law and a healthy dose of common sense," said Berkshire District Attorney David F. Capeless in a written statement. "It is imperative that those of us in law enforcement entrusted with ensuring public safety have the same tools and technology as those who would attempt to undermine it, but we must be empowered to employ those tools against all serious and violent felons."
Pittsfield attorney Timothy J. Shugrue called the decision "helpful" and said he was thankful that Ford brought the issue to the higher court's attention.
"It fills the gaping hole in the law that I think everyone recognized was there," he said.

Attorney David Pixley, whose clients also pleaded out before the ruling, said the SJC took a "common sense" approach to the issue.
He said Judge Ford was right to bring it to the higher court and that defense attorneys had to raise the issue to preserve the rights of their clients
"Everyone did the right thing, except the state [Legislature]," Pixley said. "They should have dealt with this issue a long time ago." said Pixley.
As for Moody and Newman, their cases are headed back to the Berkshire Superior Court.

So the market, or other governments, will create such ways.
What’s needed is a big investment in Internet switching capacity in countries where the spies are not completely out of control. Then non-Americans can just join one of the many servers that will spring up to meet an exploding demand for secure Internet services.
Finnish Internet servers are already emphasizing the security of their services. The Cupertino-based company filed 259 invention patent applications and 132 design patent applications in the January-June period, more than any other foreign enterprise, the IPO said.
It was the first time that Apple had captured the top spot in both patent application categories, the bureau said.
The following are excerpts from a special report on the topic in the Saturday edition of the Commercial Times:
Apple did not make much of an effort to apply for patents in Taiwan in the past, cases for iphone 5 an IPO official said Friday.
"Its attitude has changed in recent years amid mounting competition in the smartphone market," said the official.
Taiwanese smartphone maker HTC Corp.'s aggressiveness in applying for patents has also prompted the U.S. consumer electronics giant to take active steps in seeking patent protection for its high-end devices, the official said.
According to IPO statistics, Apply filed 65 times as many design patent applications and about the same number of invention patent applications in the first half of 2013 as it did during the first half of last year.
In comparison, HTC filed 124 invention patent applications in the six-month period, up 34.7 percent year-on-year.
The company also filed 32 design patent applications during the same period, more than four times the number it filed a year ago.
HTC ranked seventh among Taiwanese companies in the invention patent category and sixth in terms of design patent applications.
Samsung Electronics Co., along with Apple the strongest player in the smartphone sector, filed 93 smartphone-related invention patent applications in Taiwan during the same period, up 43 percent, and 85 design patent applications, up 157 percent.
The South Korean technology titan ranked 16th among foreign applicants in the invention patent category and second in terms of design patent applications.
Samsung's display panel division also filed 176 invention patent applications, while Taiwan's leading LCD panel maker AU Optronics Corp. filed 184 applications.
The figures reflect the intense competition seen in the flat panel industry, the IPO official said.
In the first half of the year, Hon Hai outstripped all other Taiwanese corporations in invention applications with 1,429 cases, up 2.9 percent year-on-year.
Meanwhile, HTC North Asia general manager Jack Tong said Friday that even though the company's new generation Butterfly smartphone -- the Butterfly S -- has not sold as well as the first generation model since its launch more than a month ago, HTC would remain the top selling smartphone brand in Taiwan in the third quarter.
Thanks to robust sales of the HTC Butterfly and the new HTC One models, HTC managed to reclaim its best-seller status in Taiwan in the second quarter after losing that honor to Samsung for nearly a year.

China on Wednesday announced it has sent fine bills of 108 million U.S. dollars to six mostly foreign infant formula producers for price-fixing.
They were the largest fines ever imposed for anti-trust infringements since China adopted anti-monopoly law in 2008.
The fine bills were not discriminative against foreign firms as hinted by some Western media. However, the case demonstrated that there are less and less loopholes for transnational companies to earn "easy money" in China.
Statistics has proven that China treats foreign companies and their domestic counterparts as equals in anti-trust probes.
Since the implementation of anti-trust law in 2008, the Ministry of Commerce have received over 700 complaints and it has investigated 690 cases.
Among those cases, a majority of them involved domestic companies and very few foreign firms have been targeted.
Apart from the current case, Cases for iPad 4 earlier this year, Samsung, LG and four Taiwanese markers of LCD display screens were ordered to pay a fine totalling 353 million yuan (around 58 million U.S. dollars) for price-fixing.
By comparison, the country's alcohol makers Kweichou Moutai Co., Ltd. and Wuliangye Yibin Co., Ltd. were ordered to pay a heavy price of 449 million yuan for their involvement in price manipulation.
What's more, the latest anti-trust decision does not aim at boosting domestic brands as some foreign media speculated. Instead, it might help increase market share of international formula giants thanks to the ensuing price cuts.
The question is, what lesson could international companies draw from the punishment?
Chinese market is becoming more and more regulated and international firms should obey local laws and regulations. They should give up old mentality of making use of "loopholes" to earn "easy money".
Since China's entry into the World Trade Organization (WTO), China has enacted and amended a series of laws to make them in line with the WTO norms and international practice, so as to boost lawful, orderly and robust market competition.
In the meantime, China has enhanced law enforcement in a bid to create a clean business climate for both domestic and international firms, especially since this year.
What's more, China has tightened its efforts to fight corruption and malpractices in business and commercial operations.
Last month, Chinese authorities launched a probe into international pharma giant GSK for its suspected bribery and tax-related violations.
All in all, a clean, orderly and robust market with less and less "loopholes" is good for both domestic and international companies.
It is desirable for foreign firms to incorporate international practice into their Chinese business, and renounce old practice of seeking "loopholes" in the Chinese market.
